Abstract
Texto resumen: En el presente trabajo se analiza la figura del levantamiento del velo en
un estadio procesal particular: el momento en que se pretende solicitar el despacho de la
ejecución al no haber cumplido la parte condenada con el contenido de la sentencia. Para saber
quién ostenta la legitimación pasiva necesaria para ser parte en la ejecución debemos
comprobar, en primer lugar, si el velo fue levantado en el proceso declarativo o no. Y en caso
negativo, si la conducta fraudulenta (que justifica levantar el velo) fue realizada tras el dictado
de la sentencia o, por el contrario, ya se estaba produciendo pendentem litem. La solución a
cómo se ha de proceder en cada caso la encontrarán aquí.
Texto abstract: “The present work analyzes the figure of the lifting of the veil in a particular procedural stage: the moment that creditor intends to request the enforcement order when the condemned party has not fulfilled the content of the judgment. To find out who has the passive legal standing needed to be party in the enforcement procedure, we should check, first, if the veil was raised in the declarative procedure or not. And if not, if the fraudulent conduct (which justifies lifting the veil) as performed after the judgment or, on the contrary, it was already taking place pendentem litem. The solution to how to proceed in each case will be found here".
