Abstract
El avance vertiginoso de las nuevas tecnologías de la información y la comunicación hace largo que viene transformando el mundo del trabajo. A la par que ofrece un sinfín de posibilidades técnicas al servicio de la flexibilización de las relaciones laborales, permite al empresario controlar el desempeño de sus empleados durante el horario pactado en contrato e incluso fuera de este. Como se sabe, el art. 20.3 ET le habilita para adoptar las medidas que considere oportunas en el ejercicio de sus funciones de control, siendo los sistemas de geolocalización una herramienta que no ha quedado exenta de controversias. Así las cosas, el interrogante principal es hasta dónde puede llegar la fiscalización empresarial respecto del cumplimiento de las obligaciones de sus trabajadores, si lo que se pretende es ejercer la máxima expresión de la potestad disciplinaria, esto es, el despido. Y en ese cruce de derechos fundamentales —libertad de empresa, intimidad y protección de datos personales— se erige como criterio fronterizo entre lo lícito e ilícito la información previa, que ha de ser expresa, clara e inequívoca para los trabajadores, e indicar la existencia y características de tales dispositivos. Al estudio de los pormenores de la recién referida cuestión se van a dedicar las siguientes páginas, para, finalmente, intentar exponer las conclusiones alcanzadas. --------
The rapid advancement of new information and communication technologies has long been transforming the world of work. While offering a myriad of technical possibilities to facilitate flexible labor relations, it also allows employers to monitor the performance of their empleyees during the agreed-upon working hours and, in some justified cases, even outside of them. As known, article 20.3 Workers’ Statute enables employers to adopt measures they consider appropriate in the exercise of their control functions, with geolocation systems being a tool that has not been exempt from controversies. In this context, the mainquestion i show far can corporate oversight go regarding the compliance of their employees’ obligations, if what is sought is to exercise the utmost expression of disciplinary authority, that is, dismissal. And in this intersection of fundamental rights —freedom of business, privacy and personal data protection— prior information emerges as the border criterion between what is lawful and unlawful, wich must be explicit, clear, and unequivocal for the workers, and must indicate the existence and characteristics of such devices. The following pages will be dedicated to the study of de details of the aformentioned issue, in order to finally attemp to present the conclusions reached.
