Abstract
Las condiciones singulares de la prestación de servicios en el hogar familiar han propiciado, atendida su configuración como relación laboral especial, un déficit de protección, entre otras materias, en la configuración de una acción preventiva y protectora eficaz ante los riesgos inherentes a su actividad. Fue el RDL 16/2022, de 6 de septiembre, el que puso fin a la exclusión de estas personas trabajadoras del ámbito de aplicación de la Ley 31/1995 de Prevención de Riesgos Laborales, reconociendo su derecho a la protección eficaz en materia de seguridad y salud en el trabajo, el cual se ha concretado, por vía reglamentaria, mediante el RD 893/2024, a cuyo análisis dedicamos el presente trabajo. No es, desde luego, una norma perfecta, pero supone un paso más en el acercamiento de este colectivo al marco común de derechos sociolaborales.
Abstract: The unique conditions of the provision of services in the family home have led, given its configuration as a special employment relationship, a protection deficit, among other matters, in the configuration of effective preventive and protective action against the risks inherent to its activity. It was Royal Decree-Law 16/2022, of September 6, that put an end to the exclusion of these workers from the scope of application of Law 31/1995 on the Prevention of Occupational Risks, recognizing their right to effective protection in matter of safety and health at work, which has been specified, by regulation, through RD 893/2024, to whose analysis we dedicate this work. It is, of course, not a perfect standard, but it represents another step in bringing this group closer to the common framework of sociolabor rights.
