Abstract
Si bien el art. 28.2 de la Constitución Española encomendó al legislador
la aprobación de una Ley (Orgánica) que regulase el ejercicio del derecho
fundamental de huelga y las garantías precisas para asegurar el mantenimiento de
los servicios esenciales de la comunidad, actualmente, la regulación de la huelga
en nuestro país se contiene en un Real Decreto Ley preconstitucional: el RDLRT
17/1977, de 4 de marzo, de Relaciones de Trabajo. Aun cuando, tras más de cuatro
décadas de incumplimiento del mandato constitucional, dicha norma, ha bastado
—con la depuración constitucional realizada por la STC 11/1981, de 8 de abril y
posteriores— para la regulación del derecho de huelga en nuestro país, existen
importantes razones, no sólo formales, que hacen perentoria la promulgación de
una nueva norma. El presente estudio tratará de dar cuenta de todo ello, realizando
un somero análisis de la regulación vigente y de los principales problemas
aplicativos que, durante todos estos años, ha puesto de manifiesto la necesidad
de reconducirse a una norma obsoleta, preconstitucional y con vigencia parcial
como consecuencia de la depuración operada por la jurisprudencia constitucional.
Asimismo, con relación a cada uno de estos problemas, tratarán de ofrecerse, en
un plano lege ferenda, proposiciones a incorporar en una futura Ley Orgánica de
Huelga.
Although art. 28.2 of the Spanish Constitution entrusted the legislator with the approval of an (Organic) Law that regulates the exercise of the fundamental right to strike and the necessary guarantees to ensure the maintenance of essential services of the community, currently, the regulation of strikes in Spain is contained in a pre-constitutional Real Decreto Ley: RDLRT 17/1977, of March 4, on Labor Relations. Even though, after more than four decades of non-compliance with the constitutional mandate, said norm has been sufficient - with the constitutional purification carried out by STC 11/1981, of April 8 and later - for the regulation of the right to strike in our country. There are important reasons, not just formal, that make the promulgation of a new norm urgent. The present study will try to account for all this, carrying out a brief analysis of the current regulation and the main application problems that, during all these years, have revealed the need to redirect to an obsolete, pre-constitutional and partially valid norm because of the purification carried out by constitutional jurisprudence. Likewise, in relation to each of these problems, I will try to offer proposals to be incorporated into a future Organic Strike Law.
