Abstract
Con la entrada en vigor de la nueva normativa, se pone fin a la extinción automática del contrato de trabajo al conceder una incapacidad permanente a una persona trabajadora, pudiendo quedar este en suspensión si existe posibilidad de adaptación o recolocación en la misma empresa en otro puesto de trabajo compatible con su nueva situación. En este proceso, el Servicio de Prevención de Riesgos Laborales es esencial para valorar las limitaciones que pueda presentar la persona trabajadora, así como en las posibles adaptaciones a realizar por parte de la empresa en cada caso. Destacamos el papel del médico del trabajo en la valoración de la aptitud laboral como un proceso esencial en este escenario, siendo más que relevante en la protección y promoción de la salud de los trabajadores, así como en el asesoramiento a las empresas para garantizar un entorno de trabajo seguro.
Abstract: With the new regulations now in effect, the automatic termination of employment contracts upon the granting of permanent disability benefits is eliminated. Instead, contracts may be suspended if there is a possibility of adaptation or reassignment within the same company to a position compatible with the new situation. In this process, the Occupational Health and Safety Service plays a crucial role in assessing the employee's limitations and determining the necessary adjustments the company may need to make in each case. We emphasize the role of the occupational doctor in assessing fitness for work as an essential process for ensuring safety and health in the workplace, being particularly relevant for protecting and promoting workers' health, as well as advising companies on how to guarantee a safe working environment.
