Abstract
A raíz de la STS de 18 de noviembre de 2024, las empresas tienen la obligación de ofrecer un trámite de audiencia con carácter previo al despido. En este sentido, el presente trabajo se centra en analizar los aspectos jurídicos que rodean a este trámite (a quién va dirigido, en qué modalidades de despido, en qué momento, su forma, su duración y si puede dejar de abrirse de forma excepcional).
Abstract: As a result of the Supreme Court Judgment of 18 November 2024, companies are obliged to offer a hearing procedure prior to dismissal. In this sense, this paper focuses on analyzing the legal aspects surrounding this procedure (to whom it is addressed, in what types of dismissal, at what time, its form, its duration and whether it can be stopped exceptionally).
