Abstract
Es una realidad que la bioética y el bioderecho son disciplinas cuyo objetivo va encaminado a un desarrollo humano y social en beneficio y protección de la vida en general; sin embargo, en el caso particular de la situación dentro del Estado Mexicano dichas disciplinas cuentan con una corta existencia quedando el país en un evidente rezago a comparación de otras naciones, provocando con ello una notoria ignorancia en la materia y repercutiendo en un marco jurídico carente de una visión bioética. Razón por la cual, en el presente trabajo de investigación de manera primordial se desarrolla de manera amplia la base conceptual así como el origen y antecedentes tanto de la bioética como del bioderecho analizando sus objetivos y de manera particular los principios que rigen a la bioética, otorgándole especial tratamiento al concerniente a la autonomía, por considerarlo el de mayor relevancia.
Es imposible abordar a la bioética y el bioderecho sin considerar los derechos humanos ya que estos, así como la dignidad humana dotan de sentido a los objetivos en ambas disciplinas, siendo el derecho humano a la salud uno de los más trascendentes, ya que de este parten muchas estrategias para implementar y desarrollar a la propia bioética. Motivo por el cual dentro de esta investigación se desarrolla el tema de salud de forma conceptual, abordando de manera específica a la salud física, así como la salud mental; resaltando la importancia de cada una de ellas para posteriormente entrar al estudio de la ausencia de salud, considerando las implicaciones sociales que ésta puede acarrear, así como la obligación que tiene el Estado para corregir esta ausencia de salud y con ello garantizar el derecho humano a la salud. Por último se analiza la postura actual del Estado Mexicano respecto a la aplicación de la autonomía, considerando tres casos concretos siendo el aborto, consumo lúdico de marihuana y eutanasia los desarrollados para evidenciar el casi inexistente respeto a la autonomía por parte del Estado Mexicano.
Para esta investigación se utilizó una metodología deductiva, siendo de tipo ordenadora-descriptiva con fuentes documentales y la cual tiene por objetivo visualizar la situación actual del Estado Mexicano respecto a la bioética evidenciando su escaso conocimiento de la misma y por ello contando con un aparato legislativo carente de perspectiva bioética, incumpliendo con el respeto al principio de autonomía.
Concluyendo que en la actualidad existe un notorio desconocimiento sobre bioética por parte del Estado Mexicano, contando con un amplio campo de acción y desarrollo debiendo ser un tema prioritario para el gobierno actual así como los futuros; de lo contrario se mantendrá un estado de derecho colapsado al no ser apegado a una perspectiva bioética y con ello violentando derechos humanos, sin mencionar el incumplimiento a los Tratados Internacionales de los que México forma parte y por incumplir con esta visión bioética en la actualidad transgrede lineamientos internacionales
It is a reality that bioethics and biolaw are disciplines whose objective is aimed at human and social development for the benefit and protection of life in general; however, in the particular case within the Mexican State, these disciplines have existed for a short period time, leaving the country clearly behind compared to other nations, causing a notorious ignorance on the subject and reverberating in a legal structure that lacks a bioethical visión. For this reason we primarly develop in a broad manner the conceptual basis, as well as the origin and background of bioethics as well as biolaw, analizing its objectives and particularly the principles that regulate bioethics, granting differential treatmenta to autonomy, since it´s considered the most relevant. It is imposible to approach bioethics and biolaw without considering human rights, as well as human dignity, becouse they both provide meaning to the objectives of both disciplines being the human right to health one of the most important, becouse this human right is the basis to develop and implement strategies for bioethics itself. For this reason, within this research, the topic of health is developed conceptually, specifically addressing physical health, as well as mental health, highlighting the importance of each of them, to subsequently enter in the study regarding absence of health, considering the social implications this can entail, as well as the State´s obligation to correct the absence of health and thereby guarantee the human right to health. Lastly, the current position of the Mexican State regarding the application of autonomy is analyzed, considering three specific cases: abortion, recreational marijuana use, and euthanasia, which are developed to demonstrate the almost nonexistent respect for autonomy on the part of the Mexican State. For this research, a deductive methodology was used being of an organizing-descriptive type with documentary sources and which aims to visualize the current situation of the Mexican State with respect to bioethics, demonstrating its limited knowledge of it and therefore having a legislative apparatus lacking a bioethical perspective, failing to comply with the principle of autonomy. Concluding that there is currently a notable lack of knowledge about bioethics on the part of the Mexican State, despite having a broad field of action and development, it should be a priority issue for the current and future governments; otherwise, the rule of law will remain in a state of collapse due to a lack of adherence to a bioethical perspective, thereby violating human rights. Not to mention the failure to comply with the international treaties to which Mexico is part of. By Failing to comply with this bioethical visión, it currently violates international guidelines.
