- PublicationOpen AccessAdvancing disability rights in the EU: a blueprint in the social agenda of the Spanish presidency.(Universidad de Murcia, Servicio de Publicaciones., 2023) Ferri, DeliaThe 2023 Spanish Presidency of the Council of the European Union marks the fifth time Spain has taken on this presidency since joining the former European Community (EC) in 1986. This presidential term arrives at a key juncture for the European Union (EU) as it falls in the final stretch of the EU institutional cycle before the European Parliament elections, scheduled in May 2024, which will see the appointment of a new Commission. In such a critical period, Spain is challenged with completing negotiations on strategic issues related to the digital and green transitions and a broad social agenda. Notably, at the beginning, Spain announced that “promoting greater social and economic justice”was one of the four thematic areas characterising its aspirations for its presidency. This area is quite wide-ranging, but includes specific actions related to the protection of vulnerable groups, including people with disabilities, and places strong emphasis on the advancement of the European Disability Card (EDC) as a vital instrument to enhance free movement of people with disabilities in the EU. Against this background, this article discusses the role of the Spanish Presidency in advancing disability rights within the remit of its social agenda. It focuses on the EDC as testbed for the Presidency. In fact, the Spanish support and vision will be key to bringing this forward and preparing the ground for adoption of the EDC directive, before “passing the baton” to the forthcoming Belgian Presidency.
- PublicationOpen AccessThe Proposed European Union Corporate Sustainability Due Diligence Directive : making or breaking European Human Rights Law?(Universidad de Murcia, Servicio de Publicaciones., 2023) Methven O’Brien, Claire; Christoffersen, JonasThe Proposal for a Directive on Corporate Sustainability Due Diligence (EU) 2019/1937, COM/2022/71 final, 23 February 2022, ‘CSDDD’)if enacted, would extend responsibilities, liability and exposure to administrative penalties to large economic actors for failure to comply withhuman rights and environmental obligations. The main purpose of this proposal is to establish a binding set of legal norms to increase access to legal enforcement by linking a breach of the due diligence obligation to public sanctions (Article 20) and civil liability. However, as we analyse in this article, the proposal would significantly limit the scope and content of companies' due diligence as compared to the process foreseen by the UN Guiding Principles on Business and Human Rights to which it seeks to give greater effect, while limiting the rights to be protected, and the class of companies obliged to exercise due diligence. At the same time,as we explain,the proposed Directive may jeopardize the integrity of European human rights law as articulated by the judicial and other organs of the Council of Europe, and at the national level.
- PublicationOpen AccessLa condicionalidad de los fondos europeos y las obligaciones en materia de contratación pública. la experiencia española.(Universidad de Murcia, Servicio de Publicaciones., 2023) Ordóñez Solís, DavidEl incumplimiento de las obligaciones del Derecho de la Unión, como pueden ser las relativas a los contratos públicos, constituye una irregularidad que es susceptible de correcciones financieras en los fondos europeos asignados a las autoridades nacionales y, en su caso, a las empresas y a los particulares. La regulación de los fondos europeos, especialmente de los Fondos estructurales y de cohesión, ha tratado de mejorar paulatinamente su vinculación o condicionalidad con el cumplimiento de las obligaciones europeas en materia de contratación pública. La jurisprudencia del Tribunal de Justicia, especialmente en lo que se refiere a la gestión compartida de los fondos europeos, así lo revela, subrayando la relación entre la gestión de los fondos europeos y el respeto de las normas sobre contratación pública. La experiencia española,que ha canalizado un importante volumen de fondos europeos,no es especialmente edificante en lo que se refiere al cumplimiento de las obligaciones en materia de contratación pública. Y,aun cuando se han establecido mecanismos para asegurar la repercusión de lasresponsabilidades financieras,se ha cuidado poco la mejora de la gestión de los fondos europeos y el cumplimiento de las obligaciones europeas de contratación pública.
- PublicationOpen AccessEl impacto del Derecho de la Unión Europea en el ámbito laboral: revisión jurisprudencial.(Universidad de Murcia, Servicio de Publicaciones., 2023) Vicente Andrés, RaquelLa asunción por parte de España de la Presidencia del Consejo de la Unión Europea durante el uno de julio, al próximo 31 de diciembre de 2023, permitirá avanzar en el denominado escudo social Europeo, máximo exponente del Estado del bienestar europeo, bajoel lema: una Europa más cerca, permitiendo desarrollar los principios consagrados en el Plan de Acción del Pilar Europeo de Derechos Sociales (adoptado por la Comisión en marzo de 2021), fomentando el diálogo social, el trabajo decente y la economía social, impulsando la aplicación del principio de igualdad entre mujeres y hombres. Política europea social, que marca el rumbo de la actuación legislativa nacional y jurisprudencial, impulsando una mejora en las condiciones de las personas trabajadoras, combatiendo la precariedad laboral, en ámbitos tan importantes como: la lucha contra la discriminación, la brechas en la era digital, el fraude en la contratación temporal, o la gestión de la ordenación del tiempo de trabajo. Sin duda, el impacto del Derecho de la Unión Europea, en el panorama nacional, ostenta un papel sumamente relevante, constituyendo a día de hoy el referente, en cuanto a salvaguarda de las garantías del escudo social de las personas trabajadoras.
- PublicationOpen AccessThe challenges of energy market reform:what can the Spanish Presidency achieve?(Universidad de Murcia, Servicio de Publicaciones., 2023) Hancher, LeighThe contribution examines the achievement of the three core objectives of European energy policy in the aftermath of the energy crisis of 2022. Energy security, sustainability and competitiveness have been at the root of European energy policy for many decades but progress in achieving them has been mixed. Member states can rely on their rights to choose their own energy mix. The European Union’s initial response to the energy crisis was to invoke a little used Article 122(1) of the Treatyon the Functioning of the European Union (TFEU)to adopt a series of rapidly enacted emergency legislation to promote solidarity between the 27member states.This article questions whether that response has led to an increased centralization of powers for the EU institutions at the expense of national governments? Can the EU institutions now set the policy agenda for the energy transition more efficiently? Are the EU state aid rules likely to be implemented more strictly to ensure a transition away from fossil fuels before 2050 or do national governments remain firmly in the driving seat? In the alternative, are there any emergent trends from the management of the crisis that are likely to be perpetuated in the longer term as Europe seeks to transitionas rapidly as possibleto a net zero carbon economy?
