    Los límites de la interpretación conforme de la directiva de despidos colectivos a partir del asunto Plamaro.

    Este trabajo aborda una cuestión sujeta a debate tanto en la doctrina científica como jurisprudencial, especialmente a partir de la sentencia del Tribunal de Justicia de la Unión Europea (asunto Plamaro), del pasado año 2024, que reabre el examen crítico de la normativa española en materia de despidos colectivos. El núcleo del análisis se centra en la compatibilidad de nuestro marco normativo con el Derecho de la Unión Europea, en particular con la Directiva 98/59/CE, sobre despidos colectivos. El trabajo no solo constata la necesidad de una revisión legislativa que armonice el Derecho interno con las exigencias comunitarias, sino que también pone de relieve los desafíos derivados de dicha armonización, en un terreno en el que confluyen el principio de seguridad jurídica, la autonomía de la voluntad del empresario y los derechos colectivos de las personas trabajadoras.

    Modalities of dismissal in Italy.

    In Italy the general principle is that the dismissal must be causal. This article analyzes the dismissal reform in Italy, introduced by Legislative Decree no. 23/2015, 7 March.In collective dismissal there is a specific procedure in the case of company relocations apart from the classic collective dismissal due to staff reduction. In the other hand, the reinstatement protection, in a context of dismissal for objective justified reasons, is provided only for the case in which the judge ascertains the lack of justification for the reason consisting in the employee’s physical or psychic disability, assimilating it to the hypothesis of nullity of dismissal. Regarding disciplinary dismissal, a distinction is made between the “giusta causa” and the “giustificato soggettivo motive”.

    Modalities of dismissal in Portugal.

    Time has shown that the legal historical background shapes the regulation by sedimentation. After an overview of the legal framework of termination of employment contract and that of dismissal, this paper aims to offer a critical analysis on the Portuguese law of dismissal, focusing on unfair dismissal and collective redundancy.

    Modalities of dismissal in the Republic of Croatia.

    The following paper examines the modalities of dismissal in the Republic of Croatia, providing a comprehensive overview of historical developments, as well as the current legal framework regarding the subject matter. An in-depth analysis of objective, subjective, and collective dismissals will be provided herein, tracing their evolution from the 1990s to present day. The paper highlights key legislative reforms and their impact on employment termination practices, offering valuable insights into the labour law legislation in Croatia regulating the various types of dismissals.
