Abstract
La llegada de ciudadanos marroquíes que cruzan desde la orilla
sur del Mediterráneo para vivir y trabajar en España supone un gran reto
para el Derecho nacional, por el contacto que se produce entre el Derecho
marroquí de Familia y el Derecho español. Este contacto da lugar a una
actividad traductora necesaria, tanto de actas matrimoniales como de
sentencias de disolución del matrimonio, y un sinfín de documentos. De allí
surge la necesidad de esclarecer, en nuestro caso, las diferencias existentes
entre las instituciones de disolución del matrimonio que se recogen en el
Código marroquí de Familia, como tarea previa para abordar las sentencias
de disolución del matrimonio dictadas en Marruecos
The arrival of Moroccan citizens to Spain through the Mediterranean Sea crossing it from south to north in search of opportunities to live and work in that European country is considered a big challenge for the national law to the contact that occurs between Moroccan Family Law and Spanish Law. This contact results in a necessary translation activity of both marriage certificates and judgments. Hence, the importance of clarifying, in our case, the existing differences between the different institutions in charge of marriage dissolutions which are stated in the Moroccan Family Code, as a previous step in order to address the judgments of dissolution of marriage in Morocco.
