Abstract
El Mariscal Josip Broz Tito estuvo al mando de la nación yugoslava durante 35 años, y su objetivo fue la unión de los eslavos del sur mediante la creación de una República Socialista Yugoslava, más adelante República Federal Yugoslava, la cual se desintegró tras cinco guerras civiles. Así pues, este trabajo se centra en el análisis de los sucesos acontecidos en la última década del siglo XX y que provocaron el auge de los nacionalismos, con la consiguiente desaparición de las repúblicas que componían Yugoslavia. Dentro de este proceso de desmembración, donde primaron las diferencias étnicas y religiosas de cada uno de los pueblos yugoslavos, destaca el caso de la Guerra de Bosnia (1992-1995), en la que se acometieron, como parte de ese proceso de “limpieza étnica”, auténticos crímenes de guerra, especialmente contra la población musulmana, destacando las violaciones a mujeres bosnias a manos de los serbios y serbobosnios, lo que evidenció el uso de la violencia sexual como arma de guerra, y genocidios como el de Srebrenica, que marcarán un antes y un después en la vida de sus víctimas, y que siguen siendo recordados a día de hoy. Asimismo, se aborda, desde una perspectiva humanitaria, el papel y la labor desempeñada por el Tribunal Penal Internacional para la antigua Yugoslavia (TPIY), el cual fue creado a través de una Resolución del Consejo de Seguridad de las Naciones Unidas en 1993 para condenar aquellos actos de violación de los derechos humanos esenciales, así como a los individuos y dirigentes que los perpetraron, teniendo esto una repercusión trascendental en el Derecho Internacional Humanitario.
Marshal Josip Broz Tito was in charge of the Yugoslavian nation for 35 years, and his goal was to unite the southern Slavs by creating a Socialist Federal Republic of Yugoslavia, later the Federal Republic of Yugoslavia, which disintegrated after five civil wars. Therefore, this work focuses on the analysis of the events that took place in the last decade of the 20th century, which led to the rise of nationalisms, with the consequent disappearance of the republics that made up Yugoslavia. Within this process of dismemberment, where ethnic and religious differences of each of the Yugoslav peoples prevailed, the case of the Bosnian War (1992-1995) stands out, in which acts of war crimes were committed as part of that process of "ethnic cleansing", especially against the Muslim population, highlighting the rapes of Bosnian women by Serbs and Serb-Bosnians, which demonstrated the use of sexual violence as a weapon of war, and genocides such as that of Srebrenica, which will mark a before and after in the lives of its victims and which continue to be remembered to this day. Likewise, from a humanitarian perspective, the role and work carried out by the International Criminal Tribunal for the former Yugoslavia (ICTY) is addressed, which was created through a United Nations Security Council resolution in 1993 to condemn those acts of violation of essential human rights, as well as the individuals and leaders who perpetrated them, having a transcendental impact on International Humanitarian Law.
