Abstract
OBJETIVOS: el presente trabajo ha intentado hacer un análisis lo más detallado posible de los distintos problemas con los que se encuentra la Administración Pública en lo que a la contratación laboral se refiere. Problemas que en muchas ocasiones han dado lugar a lo largo de los años a la declaración judicial de los trabajadores afectados por la irregularidad como trabajadores "indefinidos no fijos". Una vez hecho un repaso de estas circunstancias, se analizan las medidas legislativas adoptadas para hacer frente a una de las principales irregularidades de la contratación laboral de las Administraciones Públicas que es el abuso de la temporalidad en el sector público.
METODOLOGÍA: para ello, principalmente se ha realizado una observación práctica de la contratación laboral realizada por las Administraciones Públicas junto con un análisis jurisprudencial y doctrinal de los principales hitos estudiados, consiguiendo hacer un repaso histórico de las diversas circunstancias que han dado lugar con el paso de los años a la situación actual del empleo público en España. Completándolo con un análisis de las recientes reformas legislativas introducidas por la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en el empleo público y por el Real Decreto-ley 32/2021, de 28 de diciembre, de medidas urgentes para la reforma laboral, la garantía de la estabilidad en el empleo y la transformación del mercado de trabajo, y su repercusión en el empleo público español. 3. RESULTADOS: después de realizar un estudio detallado del tema, se ha llegado a la innovadora conclusión de que es posible defender la desaparición del "indefinido no fijo" a raíz de la redacción actual de determinados artículos introducidos tras las últimas reformas legislativas. Esta interpretación supondría un giro radical en el empleo público en España, permitiendo su reconfiguración hacia un empleo estable y realmente basado en los principios constitucionales de igualdad, mérito y capacidad.
OBJECTIVES: this paper has attempted to carry out a detailed analysis of the different problems faced by Public Administration in relation to employment contracting. Problems that, on many occasions over the years, have led to judicial declarations of the affected workers as 'non-permanent employees'. Once these circumstances have been reviewed, the legislative measures adopted to address one of the main irregularities in public sector employment contracting-namely the abuse of temporary employment-are analyzed. METHODOLOGY: for this purpose, a practical observation of employment contracting carried out by Public Administrations has mainly been conducted, together with a jurisprudential and doctrinal analysis of the main studied milestones. This has made it possible to make a historical review of the various circumstances that, over the years, have led to the current situation of public employment in Spain. This has been complemented with an analysis of the recent legislative reforms introduced by Law 20/2021, of December 28, on urgent measures to reduce temporary employment in the public sector, and by Royal Decree-Law 32/2021, of December 28, on urgent measures for labor reform, the guarantee of employment stability, and the transformation of the labor market, as well as their impact on Spanish public employment. 3. RESULTS: reaching the innovative conclusion that it is possible to defend the disappearance of the 'non-permanent employee' as a result of the current wording of certain articles introduced after the latest legislative reforms. This interpretation would represent a radical shift in public employment in Spain, allowing its reconfiguration towards stable employment truly based on the constitutional principles of equality, merit, and capability.
