Abstract
Frente a quienes consideran que solo debe recurrirse a la mediación si así se desea de forma espontánea o libre,
hay quienes defienden que no es contrario a la esencia de este medio de gestión de conflictos que también pueda
ser sugerido por los tribunales de justicia o, incluso impuesto por el legislador en algunos casos, como condición de
procedibilidad. En el presente estudio abordamos dichas cuestiones con el propósito de analizar cuál es el criterio del
legislador europeo en esta materia y si sería contrario al derecho fundamental a ser tutelado judicialmente de forma efectiva
que, en una futura reforma, se nos exigiese acudir a mediación antes de ejercitar, en su caso, determinadas acciones ante la
jurisdicción y, en consecuencia, antes de que se interpusieran algunas demandas

Opposed to those who consider that mediation should only be used if it is spontaneously or freely desired, there are those who defend that it is not contrary to its essence, if this mean of conflict management can also be suggested by the courts of justice or, even imposed in some cases by the legislator, as a procedural condition. In the present study, such issues are considered with the purpose of analyzing the European legislator's criteria in this matter and whether it would be contrary to the fundamental right to be legally protected in an effective way the requiremente to go to mediation before to exercise specific actions before the jurisdiction and, consequently, before any lawsuits were filed.
