Abstract
En este trabajo se realiza un análisis del accidente de trabajo en la modalidad de prestación de servicios de teletrabajo. Para ello, se realiza un análisis de los elementos configuradores del concepto de accidente de trabajo, en especial de la presunción de tiempo y lugar de trabajo, para analizar su adecuación a las distintas modalidades de teletrabajo, pues ni la Ley de Trabajo a Distancia, ni la normativa de Seguridad Social ofrecen una solución a las posibles controversias que se pudieran plantear en esta materia.
In this work, it is carried out an analysis of the work accident in the modality of teleworking services. For this, it is realized an analysis of the elements that configure the concept of work accident, a legal figure of eminently jurisprudential construction, especially the presumption of time and workplace, to analyze its adaptation to the different modalities of teleworking, since neither Labor Law, nor the social security regulations offer a solution to the possible controversies that could arise in this matter.
