dc.description.abstractEste trabajo nace con el propósito de servir de guía tanto para profesionales, bien de la educación o del Derecho, como para padres de alumnos, o bien a cualquier persona que pueda estar interesada. Pese a ser un fenómeno que lamentablemente se repite en los centros docentes con una indeseable frecuencia, existe un desconocimiento generalizado sobre el régimen jurídico que lo regula entre quienes pueden verse afectados: padres, docentes y alumnos. Para facilitar tanto a padres como a docentes un acercamiento a este régimen jurídico de la responsabilidad de centros docentes, este trabajo comienza con una sucinta introducción al Derecho de daños para posteriormente exponer un estudio histórico de la figura de la responsabilidad de los docentes, haciendo hincapié en las reformas legislativas existentes y finalmente centrarse en la regulación actual, recogida fundamentalmente en los artículos 1903.5 y 1904 del Código Civil, así como todas sus vicisitudes y particularidades.es
dc.description.abstractThe principal aim of this research is to guide not only law and educational professionals and scholar or student’s parents, but also everyone that might show interest in this matter, teachers and educators liability regulation. Though it is regretful to say that accidents are frequently occurring in educational institutions, those principally affected: parents, teachers, scholars and students, are generally unaware of how our law solves problems of this kind when arising. Accidents suffered by scholars and students in educational institutions constitute a sensitive social matter never to be overlooked. In order to provide parents and teachers with the headlights of what our legal system says, this research will start with a brief introduction on Tort Law followed by a study of the historical evolution of teacher’s and educator’s liability outstanding legislative reforms, and will finally focus on the present and applicable legislation fundamentally ruled by articles 1903.5 and 1904 of our Civil Code together with its vicissitudes and the characteristics and requirements that are to be met.
