Abstract
En el presente estudio se abordan dos cuestiones de gran trascendencia con relación a la prueba electrónica en el proceso laboral: por un lado, si es posible acceder a datos e información electrónica en poder de la contraparte para proponer posteriormente como fuente de prueba en el proceso laboral; por otro lado, la posibilidad de adopción de medidas de aseguramiento de las pruebas obtenidas. Al respecto, se defiende que los artículos 76.4 y 90. 4 de la LJS permiten solicitar y obtener, mediante el auxilio judicial, el acceso a las pruebas electrónicas que, de otro modo, no se podrían obtener, y que, por su parte, el art. 78.2 LJS, si bien adolece de un contenido adecuado, ofrece, en consonancia con el art. 297.1 LEC, un cauce para garantizar la preservación de las informaciones electrónicas que pueden constituir prueba en el proceso laboral.
This study addresses two issues of great importance in relation to electronic evidence in the labor process: on the one hand, whether it is possible to access data and electronic information held by the counterparty to subsequently propose it as a source of evidence in the labor process; on the other hand, the possibility of adopting measures to ensure the evidence obtained. In this regard, it is argued that articles 76.4 and 90.4 of the LJS allow for requesting and obtaining, through judicial assistance, access to electronic evidence that, otherwise, could not be obtained, and that, for their part, the art. 78.2 LJS, although it lacks adequate content, offers, in line with art. 297.1 LEC, a channel to guarantee the preservation of electronic information that may constitute evidence in the labor process.
