Abstract
Con la Ley 39/2006, de 14 de diciembre, de promoción de la autonomía personal y atención a las personas en situación de dependencia emergió, en España, un nuevo derecho subjetivo encaminado a asegurar los cuidados y atenciones precisas para las personas que lo necesitarán
en algún momento de sus vidas. Tanto el desarrollo normativo interno como la progresiva implantación de los distintos recursos ha sido desigual en el conjunto del Estado, incluso en los procesos de valoración de las situaciones de dependencia, hecho sobre el que este trabajo se propuso indagar. Mediante la revisión de literatura específica, un análisis normativo
y la aplicación de un cuestionario ad hoc a personal técnico o gestor de los órganos autonómicos superiores con competencias en la materia, se constata que tanto el baremo de valoración de dependencia como la escala de valoración específica están siendo aplicados por equipos interprofesionales. Sin embargo, existen diferencias relevantes que pueden estar afectando a la igualdad en el acceso a los distintos recursos del sistema. Por otra parte, se expone la capacidad del Trabajo Social para liderar estos equipos e incorporar de forma expresa el análisis y valoración de los entornos reales donde se desenvuelven las personas interesadas.
With Law 39/2006, of December 14, on the promotion of personal autonomy and care for people in a situation of dependency, a new subjective right emerged in Spain aimed at ensuring precise care and attention for people who need it at some point in their lives. Both the internal regulatory development and the progressive implementation of the different resources have been uneven throughout the State, even in the processes of assessing situations of dependency, a fact that this paper set out to investigate. Through the review of specific literature, a normative analysis, and the application of an ad hoc questionnaire to technical personnel or managers of the higher autonomous bodies with competences in the matter, it is verified that both the dependency assessment scale and the specific assessment scale are being applied by interprofessional teams. However, there are relevant differences that may be affecting equality in access to the different system resources. On the other hand, the capacity of Social Work to lead these teams and expressly incorporate the analysis and assessment of the real environments where the interested people operate is exposed.
