Abstract
Argentina es un país que reconoce el Derecho Humano a la Alimentación Adecuada (DHAA) en varios textos normativos, incluso a nivel constitucional. Sin embargo, a principios de la década de 2020, 16,7 millones de personas en Argentina (37% de la población) se encontraban en situación de inseguridad alimentaria grave o moderada. En esta investigación de metodología analítica, descriptiva, documental y telemática, el objetivo es analizar la ley argentina 25.724, de 27 de diciembre de 2002, que instituyó el Programa Nacional de Nutrición y Alimentación. Se plantea la hipótesis de que, ante el escenario de violación masiva del derecho a la alimentación, la citada ley presenta aspectos susceptibles de crítica y posibles revisiones. Confirmando la hipótesis, como resultados, se encontró que una reforma en la ley, con la universalización de los beneficiarios de las políticas públicas alimentarias, funcionaría como alternativa para enfrentar la situación de hambre que actualmente se observa en Argentina.
Abstract: Argentina is a country that recognizes the Human Right to Adequate Food (HRAF) in several normative texts, including at the constitutional level. However, at the beginning of the 2020s, 16.7 million people in Argentina (37% of the population) were severely or moderately food insecure. In this research using analytical, descriptive, documentary and telematic methodology, the objective is to analyze Argentine law 25,724, of December 27, 2002, which established the National Nutrition and Food Program. The hypothesis is raised that, given the scenario of massive violation of the right to food, the aforementioned law presents aspects susceptible to criticism and possible revisions. Confirming the hypothesis, as results, it was found that a reform in the law, with the universalization of the beneficiaries of food public policies, would function as an alternative to face the hunger situation currently observed in Argentina.
