Abstract
En lo que va de 2022 se ha producido una intensa acción legislativa sobre el
precio del transporte de mercancías por carretera, justificada sobre el papel por
la inaplazable necesidad de asegurar la sostenibilidad del sector ante el notable
y continuado aumento de los costes de los portes debido a la pandemia de la
covid-19 y más recientemente a la atroz y execrable agresión de Rusia a Ucrania.
En esta ocasión trataré del fundamento, naturaleza, contenido y alcance de
la medida seguramente más incisiva de las aprobadas en esta materia. Me refiero
a la garantía de que el precio del porte no sea inferior al total de los costes efectivos
individuales soportados por el transportista para llevarlo a cabo, establecida
en el Real Decreto-ley 14/2022. Esta es una medida de intervención del precio
de transporte, cuestionable en todos sus aspectos, desde la sinceridad de los
objetivos de política legislativa que inspiran su implantación, hasta la calidad
técnica de las normas que la articulan y su dudosa efectividad y utilidad, pasando
por el desacierto de emplazar la regla fundamental, la obligación de convenir
un precio igual o superior a los costes, en la LCTTM, a pesar de que constituye
regulación de la actividad del transporte y debiera alojarse en la LOTT, o por la
falta de coordinación entre el alcance de esa obligación legal y el mecanismo
diseñado para asegurar su observancia. A la discusión de estas cuestiones se
dedican las líneas que siguen. ----------------------------
So far in 2022, there has been intense legislative action on the price of the carriage of goods by road, officially justified because of the urgent need to ensure the sustainability of the sector in the face of the notable and continuous increase in freight costs due to the covid-19 pandemic and more recently to Russia’s heinous aggression against Ukraine. On this occasion I will deal with the objectives, nature, content, and scope of the surely most incisive measure of those recently passed in this matter. I am referring to the guarantee that the carriage price is not less than the total of the individual effective costs borne by the carrier to perform its service, established in the R.D.L. 14/2022. This is a transport price intervention measure, which is questionable in all its aspects, from the sincerity of the legislative policy objectives that inspire its establishment, to the technical quality of the regulations that articulate it and its dubious effectiveness and usefulness, through the mistake of locating the fundamental rule, the obligation to agree on a price equal to or greater than the costs, in the Law for the land transportation, despite the fact that it constitutes regulation of the transport activity and should be included in the Law for regulation of the land transportation, or due to the lack of coordination between the scope of that legal obligation and the mechanism designed to ensure its observance. The discussion of these questions will be addressed in the following lines.
