dc.description.abstractLa confrontación judicial de pareceres no es la única solución para dirimir conflictos jurídicos de índole privado. Posiblemente tampoco la más deseable. Pues, siempre que sea posible, parece preferible un acuerdo negociado que el desgaste emocional y económico que todo proceso lleva consigo y que sean los tribunales los que decidan el conflicto. Consciente de esta realidad, el Gobierno remitió a las Cortes Generales hace unos meses un proyecto de ley en el que se regulan los llamados «medios adecuados de solución de controversias en vía no jurisdiccional» y se obliga a los ciudadanos a buscar una solución consensuada antes de solicitar, en su caso, la tutela de los órganos jurisdiccionales, lo que parece desacertado y, a nuestro juicio, no favorecerá su implantación social. A partir de ahí y de otra premisa no menos relevante, la de que el proceso ofrece una solución civilizada acorde al ordenamiento jurídico, en el presente estudio analizamos algunos de esos instrumentos para la paz social, poniendo de manifiesto su parca regulación, diversas carencias, aspectos que a nuestro parecer deberían enmendarse y soluciones prácticas para algunos de los problemas que pueden suscitarse.es

dc.description.abstractThe judicial confrontation of opinions is not the only solution to solve legal conflicts of a private nature. Either possibly not the most desirable. Whenever possible, a negotiated agreement seems preferable to the emotional and economic exhaustion that any process entails and that the courts decide the conflict. Aware of this reality, the Spanish Government sent few months ago to the Parliament (“Cortes Generales”) a bill that regulates the so-called "adequate means of non-jurisdictional dispute resolution" and obliges to seek a consensual solution before requesting, where appropriate, the protection of the courts. This is something that seems unwise and, in our opinion, will not favour its social implantation. From there and from another no less relevant premise, that the process offers a civilized solution in accordance with the legal system, in the present study we analyse some of these instruments for social peace, highlighting their scant regulation, various deficiencies, aspects that we believe should be amended and practical solutions to some of the problems that may arise.es
