Abstract
En el siguiente trabajo se analiza la responsabilidad civil y la responsabilidad patrimonial del personal sanitario y de los centros médicos por el uso de productos sanitarios defectuosos, así como de la responsabilidad patrimonial de la Agencia Española de Medicamentos y Productos Sanitarios, en la medida que es el organismo que autoriza el uso en el ámbito sanitario de los productos sanitarios o, cuando menos, es la responsable de vigilar la eficacia del producto una vez incorporado al mercado o está siendo utilizando en tratamientos médicos.
The following paper analyses the civil and patrimonial liability of healthcare personnel and medical centres for the use of defective medical devices, as well as the financial liability of the Spanish Agency for Medicines and Health Products, insofar as it is the body that authorises the use of medical devices in the healthcare field or, at least, is responsible for monitoring the efficacy of the product once it has entered the market or is being used in medical treatments.
