Abstract
En la producción de un AT, pueden intervenir un amplio número
de protagonistas, algunos incluso completamente ajenos a la relación de trabajo. Para
proceder a su estudio es preciso delimitar qué fundamento jurídico justifica que se les
pueda atribuir alguna responsabilidad derivada de esa relación a la que en principio son
ajenos.
La conducta de esos terceros no exonerará al empleador de su
responsabilidad1 (artículo 14.4 LPRL), que incluso puede verse obligado a responder
por los actos de aquellos, pero también pueden responder por el incumplimiento de las
obligaciones normales derivadas de las funciones que les están atribuidas, no sólo en
acciones de repetición (artículo 14.4 LPRL), sino porque les puede alcanzar
responsabilidad civil o penal directamente exigible frente a todos ellos.
The event of a work-related accident may involve a large number of players, some even completely unrelated to the employment relationship. To carry out their specific study, it is necessary to limit whatever legal basis attributing to them any liability with regards to that in-principle unrelated relationship. The conduct of these third parties shall not dismiss the employer´s liability (Article 14.4 LPRL), with the latter even being forced to atone for the acts of the former. Moreover, the employer could also find itself in breach of normal obligations the third parties are dealing with, not only in actions for recovery (Article 14.4 LPRL). Thus, civil or criminal liability can as well be directly enforceable against them all.
