dc.description.abstractSin cuestionar el acierto del legislador en el reconocimiento de la guarda de hecho como medida de apoyo, los hechos han sido tozudos en demostrar que su incorporación al tráfico jurídico no iba a estar exenta de dificultades, en particular, en lo que se refiere a la intervención del guardador en el ejercicio de las facultades representativas ante las entidades financieras. Para intentar solucionar los problemas planteados ve la luz el Documento interpretativo sobre la guarda de hecho en la Ley 8/2021. suscrito por Fiscalía General del Estado y las asociaciones bancarias, a cuyo estudio vamos a dedicar las páginas que siguen.es
dc.description.abstractWithout questioning the legislator’s wisdom in recognising de facto guardianship as a support measure, the facts have been stubborn in demonstrating that its incorporation into the legal system was not going to be free of difficulties, in particular, with regard to the guardian’s intervention in the exercise of representative powers before financial institutions. In an attempt to solve the problems raised, the Interpretative Document on the de facto guardianship in Law 8/2021, signed by the Fiscalía General del Estado and the banking associations, was published, to the study of which we will devote the following pages.es
