Abstract
El régimen de instalación de las grandes superficies comerciales es
una de las cuestiones más controvertidas del Derecho público. Esta materia, que ha sido
objeto de una larga evolución normativa, fue ampliamente modificada por la aprobación
de la Directiva de servicios, la cual requirió una importante adaptación del Derecho
interno, al prohibir que se mantuvieran regímenes de autorización administrativa
basados en criterios estrictamente económicos. Teniendo en cuenta estas premisas, se
analizan en el presente trabajo las principales modificaciones introducidas en el Plan de
Establecimientos Comerciales por el Decreto-Ley 12/2014, de 7 de octubre, por el que
se modifica el Decreto Legislativo 1/2012, de 20 de marzo, por el que se aprueba el
Texto Refundido de la Ley del Comercio Interior de Andalucía, que pretende así dar
cumplimiento a los requerimientos de la Comisión Europea.

This matter, which has been the subject of a long legal developments, was extensively modified by the approval of the EU Directive 2006/123, dated December 12th 2006 and known as the Services Directive, which required a significant transpose by barring administrative authorization regimes based on strictly economic criteria are maintained. Given these premises, in this paper are analysed the main amendments of the Plan of Commercial Establishments by Decree- Law 12/2014, 7th October, which modifies the Legislative Decree 1/2012, 20th March, approving the Consolidated Law on Internal Trade in Andalusia, trying to give effect to the requirements of the European Commission.
