Abstract
La Convención sobre los Derechos del
Niño es el instrumento universal de referencia
en toda acción que concierna al
niño. España, Estado parte en la Convención
y en sus Protocolos facultativos, está
obligada a adoptar políticas que garanticen
los derechos proclamados en ellos a
todo niño bajo su jurisdicción, encontrando
oportunas indicaciones para ese fin en
la doctrina del Comité de los Derechos
del Niño y sus Observaciones a los informes
españoles. El enfoque en derechos y
la optimización de recursos, en el sentido
más amplio posible, se imponen como
criterios rectores de esas políticas. Y ello
adquiere especial urgencia en momentos
de crisis económica como la actual, que
permiten advertir la inversión en los derechos del niño como garantía en la construcción de sociedades futuras más justas
y preparadas.
The Convention on the Rights of the Child is the universal reference instrument on every action with regard to childhood. As a State party of the Convention and its Facultative Protocols, Spain is obli ged to adopt different policies in order to guarantee the rights proclaimed in these treaties for every child under its jurisdic tion. Appropriate indications can be found in the doctrine of the Committee on the Rights of the Child and its Observations to Spanish reports. There are two main criteria for the implementation of these policies: the approach on the rights and the optimization of resources, on a wide sense. This is particularly important in periods of financial crisis, as at present, which make it possible to appreciate the investment on children’s right as a guaran tee on the construction of a more just and prepared society.
