Abstract
La siniestralidad laboral es un problema social que exige una solución. La prevención de riesgos laborales ha tenido un especial desarrollo normativo. El legislador aspira a ofrecer una respuesta inmediata a las altas cifras de accidentes laborales que, debido a los importantes intereses en juego, ha justificado la intervención administrativa sancionadora y penal.
Ambas ramas del control social formal aspiran a prevenir las conductas infractoras en el ámbito laboral. Con intención de evitar una laguna de punibilidad, encontramos coincidencias en el orden penal y administrativo que dificultan la tarea del intérprete jurídico. De ahí, la necesidad de ofrecer pautas de interpretación que faciliten la aplicación y efectividad de la norma.
Occupational accidents are a social problem that requires a solution. The prevention of occupational risks has had a special normative development. The legislator aims to provide an immediate response to the high numbers of occupational accidents, which, together with the important interests at stake, has justified the administrative sanctioning and criminal intervention. Both branches of formal social control aim at preventing offending behaviour in the workplace. In order to avoid a penalty gap, we find overlaps in the criminal and administrative order that make the task of the legal interpreter difficult. Hence thye need to provide guidelines for interpretation to facilitate the application and effectiveness of the law.
