Abstract
La sentencia comentada constituye una ocasión idónea para reflexionar, a la vista de un
caso concreto (un contrato de suscripción a un sitio web dedicado a la búsqueda de
pareja) sobre las dificultades prácticas que plantea la determinación de los efectos del
ejercicio por el consumidor del derecho de desistimiento en contratos relativos al suministro
de servicios digitales, y también sobre la delimitación -recientemente incorporada
de manera expresa a la legislación comunitaria- entre estos contratos y aquellos que
tienen por objeto el suministro on line de contenidos digitales; todo ello en el contexto
de las modificaciones introducidas por las recientes Directivas comunitarias sobre contratos
de consumo y sobre regulación de los mercados digitales, que están obligando a
afrontar una profunda revisión del Derecho español vigente en estas materias.
The commented judgment provides an ideal occasion to reflect, in view of a specific case (a subscription contract to a website dedicated to the search for a life parlner) on the practical difficulties posed by the determínation of the effects derived from the exercise by the consumer of the right of withdrawal in contracts related to the supply of digital services, and also on the delimitation -only recently incorporated into EU legislationbetween these contracts and those whose purpose is the online supply of digital content. All this in the context of the modifications introduced by the recent EU Directives on consumer contracts and on the regulation of digital markets, which are forcing a thorough review of current Spanish law in these matters.
