dc.description.abstract	Partiendo del actual régimen de responsabilidad aplicable a representantes aduaneros en cuanto a la deuda aduanera y tributaria analizaremos la reforma aduanera propuesta por la Comisión. Mediante la misma se pretende incrementar la responsabilidad de los representantes aduaneros. La creación de la figura Trust & Check para grandes cargadores, disminuyendo los controles sobre estos, implica que la seguridad en las operaciones internacionales de estos operadores dependa en mayor medida de la buena fe. El menor control de los Trust & Check viene acompañado de un incremento de responsabilidad de los representantes aduaneros, llegando a identificarlos con la figura del importador y el exportador. Cuando en realidad, el hecho imponible se realiza por los importadores o exportadores efectivos, lo cual, genera controversia, que por otra parte no es nueva, respecto a la responsabilidad objetiva que han de sufrir los representantes aduaneros con independencia de la diligencia con la que practiquen su profesión. Y por otra, provoca distorsiones respecto a si tal régimen de responsabilidad se genera en respeto al principio de capacidad económica. -------------------	es
dc.description.abstract	Starting from the current liability regime applicable to customs representatives for customs and tax debts, we will analyse the customs reform proposed by the Commission. The reform aims to increase the liability of customs representatives. The creation of Trust & Check for large shippers, reducing controls over them, means that the security of these operators international operations depends to a greater extent on good faith. The reduced control of Trust & Check is accompanied by an increase in the responsibility of customs representatives, to the extent that they are identified with the figure of the importer and exporter. In reality, the taxable event is carried out by the actual importers or exporters, which generates a controversy, which is not new, regarding the objective liability that customs representatives must suffer regardless of the diligence of their profession. On the other hand, it causes distortions as to whether such a liability regime is generated in respect of the principle of economic capacity.	es
