Abstract
Las normas españolas de Derecho internacional privado que determinan la Ley aplicable a la
celebración del matrimonio conducen en algunos aspectos a la Ley nacional de los contrayentes. La
aplicación de esas Leyes nacionales puede ser problemática para las autoridades españolas, sobre todo
cuando dichas Leyes pertenecen a una cultura jurídica alejada como es la islámica. En este trabajo se
estudia el contenido de los Derechos de inspiración islámica y los problemas que genera su aplicación a la celebración del matrimonio en España, proponiéndose soluciones a los mismos desde la perspectiva del Derecho internacional privado.
Spanish private international law rules that determine the law applicable to the celebration of marriage usually lead to the application of the national law of the intending spouses. The application of these legal systems can be very problematic for Spanish authorities, especially when they belong to a remote legal tradition, such as the Islamic legal culture. In this paper, the content of these Muslim inspired legal systems is analyzed, together with the problems of application that they cause, in order to suggest possible solutions from a private international law perspective.
