Abstract
El presente trabajo tiene como objetivo evidenciar la integración de las personas de edad avanzada en el discurso de la CDPD y por ende la aplicación a las mismas de la Ley 8/2021, de 2 de junio. En particular se insiste en que su discapacidad no tiene por qué incidir en su derecho a ejercer su capacidad jurídica a través de medidas de apoyo, en igualdad de condiciones con las demás personas y con pleno respeto a su voluntad.Tras una breve introducción, la primera parte del trabajo se centra en el estudio de la vejez como circunstancia discapacitante, reservándose la segunda parte para realizar una aproximación al ejercicio de la autonomía decisoria en este escenario de vulnerabilidad por razón de edad, con especial atención a la dimensión asistencial y representativa del apoyo y al protagonismo de la voluntad en su elección
The aim of this paper is to highlight the integration of elderly people in the dis-course of the CRPD and therefore the application to them of Law 8/2021 of 2 June. In particular, it is stressed that their vulnerability does not necessarily affect their right to exercise their legal capacity through support measures, on an equal footing with other people and with full respect for their wishes.After a brief introduction, the first part of the paper focuses on the study of old age as a disabling circumstance, reserving the second part for an approach to the exercise of decision-making autonomy in this scenario of vulnerability due to age, with special attention to the welfare and representative dimension of support and to the protagonism of the will in its choice
