Abstract
La LCSP, en su art. 1.3, afirma que en toda contratación pública deben incorporarse de manera transversal y preceptiva criterios sociales y medioambientales, debiendo guardar estoscriterios relación con el objeto del contrato. El legislador ha entendido que al inclusión de estos criterios proporciona una mejor relación calidad-precio en la prestación contractual, así como una mayor y mejor eficiencia en la utilización de los fondos públicos. Los órganos públicos en sus pliegos de contratación deben inclinarse por la inclusión preferente de criterios sociales y medioambientales objetivos frente a los subjetivos. Este trabajo se centra en el análisis y estudio del control y verificación del cumplimientos de estos criterios sociales y medioambientales.
The LCSP, in Article 1.3, states that social and environmental criteria must be incorporated transversally and mandatorily in all public procurement, and these criteria must be related to the object of the contract. The legislator has understood that the inclusion of these criteria provides a better quality-price ratio in contractual performance, as well as greater and better efficiency in the use of public funds. Public bodies, in their procurement specifications, should prioritize the inclusion of objective social and environmental criteria over subjective ones. This paper focuses on the analysis and study of the monitoring and verification of compliance with these social and environmental criteria.
