dc.description.abstract	La prestación por desempleo ha sido ligeramente modificada por la Ley 31/2022, de 23 de diciembre, de Presupuestos Generales del Estado para el año 2023. Dicha modificación ha consistido en incrementar el porcentaje a aplicar sobre la base reguladora, del 50 al 60%, a partir del día 181º del derecho al percibo. Tomando esto como excusa, el presente artículo se propone exponer además algunos de los pronunciamientos judiciales más recientes que, a juicio de quien escribe, han destacado bien por su repercusión bien por lo rebuscado de los supuestos sobre los que han tenido que resolver. Así, se aborda la inclusión del personal doméstico en el ámbito subjetivo de la protección por desempleo vía RD-Ley 16/2022. Se analizan dos pronunciamientos que han venido a decidir sobre cómo debe articularse la prestación con distintos tipos de excedencia, a saber, la forzosa por cuidado de hijo y la voluntaria cuando la empresa incumple sus obligaciones relativas al reingreso del trabajador. También es objeto de análisis el tratamiento dispensado a los contratos fijo-discontinuo y a tiempo parcial con “jornada concentrada”, en lo que a los períodos de inactividad se refiere. Y, por último, se comenta la reciente sentencia del TS que ha tenido que resolver sobre la extensión o no de la ficción cotizatoria por parto al subsidio por desempleo para mayores de 52 años. -------------
dc.description.abstract	Unemployment benefit has been slightly modified by Law 31/2022 of 23 December on the General State Budget for 2023. This modification consisted of increasing the percentage to be applied to the regulatory base from 50% to 60% as of the 181st day of entitlement. Taking this as an excuse, this article also sets out to present some of the most recent judicial pronouncements which, in the opinion of the author, have stood out either for their impact or for the complexity of the cases on which they have had to rule. Thus, the inclusion of domestic staff in the subjective scope of unemployment protection via RD-Law 16/2022 is addressed. Two pronouncements are analysed that have ruled on how the benefit should be articulated with different types of leave of absence; namely compulsory leave to care for a child, and voluntary leave when the company fails to fulfil its obligations regarding the worker’s reinstatement. The treatment of permanent-discontinuous and part-time contracts with “concentrated working hours”, as far as periods of inactivity are concerned, is also under scrutiny. Lastly, there is a commentary on the recent SC ruling on whether or not to extend the concept of contribution for childbirth to unemployment benefit for the over 52s.
