Abstract
El propósito de este artículo es el de examinar la posible afectación de un cambio
sobrevenido de las circunstancias a la eficacia de un pacto celebrado en contemplación
de una eventual ruptura matrimonial a la luz de lo que se dispone en el Código civil de
Cataluña y concretamente en su art. 231-20.5. Tras una disertación sobre el concepto,
sentido actual y la eficacia vinculante de estos pactos y específicamente de aquellos que
se ocupan de materias de convenio regulador, se realiza un análisis más pormenorizado
del ámbito de aplicación de la regla de ineficacia por alteración sobrevenida de
circunstancias que se contiene en el art. 231-20.5 y de los requisitos que se exigen en el
texto legal para su efectividad y que difieren, en parte, de los exigidos para la
modificación de medidas definitivas de un procedimiento matrimonial.
The purpose of this article is to examine the possible effect of a subsequent change of circumstances on the effectiveness of an agreement entered in contemplation of an eventual marital breakdown in light of the provisions of the Catalan Civil Code and specifically in its art. 231-20.5. After a dissertation on the concept, current meaning and binding effectiveness of these agreements and specifically of those that deal with matters of agreements incorporated into court proceedings, a more detailed analysis is made of the scope of application of the rule of ineffectiveness by subsequent alteration of circumstances contained in art. 231-20.5 and of the requirements demanded in the legal text for its effectiveness and that differ, partially, from those demanded for the modification of definitive measures of a matrimonial proceeding.
