Abstract
En el presente trabajo nos centraremos en
tres aspectos de la Convención sobre los
Derechos del Niño: su significado y su alcance
en los últimos 20 años, y sus principales
retos de futuro para los próximos
10 años.
Para ello nos detendremos, en primer lugar,
en un análisis del significado de la
Convención y el contexto de la evolución
del derecho internacional de los derechos
humanos. En segundo lugar presentamos
brevemente el contenido de la Convención,
a fin de comprender su alcance y,
finalmente, haremos un análisis del principal
reto al que deberá enfrentarse en los
próximos años: las implicaciones principales
que supondrá para el Comité de
los Derechos del Niño la entrada en vigor,
en un futuro no muy lejano, de un tercer
Protocolo Relativo a un procedimiento de
comunicaciones.
In this work, we are focussing on three as pects of the Convention on the Rights of the Child: its meaning and its scope in the last 20 years, and its main challenges over the coming 10 years. To do this, we will firstly look at an analy sis of the meaning of the Convention and the context of the evolution of the inter national right to Human Rights. Secondly, we will briefly present the content of the Convention, to understand its scope and f inally we will analyse its main challenge over the next few years: the main implica the main implica the main implica tions that the third Protocol on a commu on a commu nication procedure will represent for the Committee of the Rights of the Child when it comes into force in the not too distant future.
Pour ce travail, nous allons nous concentrer sur trois aspects de la Convention sur les Droits de l’Enfant : son sens et sa portée sur ces 20 dernières années et les principaux défis pour les 10 prochaines années. Nous nous arrêterons dans un premier temps sur une analyse du sens de la Convention et sur le contexte de l’évolution du droit international des Droits de l’Homme. Dans un deuxième temps nous allons présenter brièvement le contenu de la Convention afin d’en comprendre la portée puis, finalement, nous analyserons le principal défi auquel il faudra faire face au cours des prochaines années : les principales responsabilités qu’impliquerait pour le Comité des Droits de l’Enfant l’entrée en vigueur dans un avenir plus ou moins proche du troisième Protocole etablissant une procédure de présentations de communications.
