Abstract
En el orden civil, para ganar un pleito no basta con tener razón: es preciso acreditar que efectivamente se tiene
derecho a obtener la tutela judicial que se solicita. Teniendo presente dicha máxima, en el presente trabajo se
analiza la llamada «prueba electrónica», haciendo hincapié en: i) que, con dicha expresión, se hace referencia en realidad a
una fuente de prueba, no a uno de los medios regulados en la ley para incorporar a un proceso una realidad anterior a éste y
poder valorarla en él; ii) cómo debe haberse obtenido la información que consta en determinados dispositivos o mecanismos electrónicos para que pueda ser admitida en la causa; iii) las vías o medios de prueba a través de los cuales puede trasladarse
al juzgador dicha información; y iv), finalmente, los criterios conforme a los cuales ha de valorarse

In civil matters, to win a lawsuit it is not enough to be right: it is necessary to prove actually having the right to obtain the judicial protection that is requested. Bearing this sentence in mind, this work analyzes the so-called «electronic evidence», emphasizing that: i) such expression actually refers to a source of evidence, not to one of the means regulated by law to incorporate previous reality to a process and to assess it within the process itself; ii) how the information contained in certain electronic devices or mechanisms should be obtained so that it can be admitted to the case; iii) the means of proof through which such information can be transferred to the judge; and iv) finally, the criteria according to which this evidence is to be assessed.
