Abstract
El presente trabajo tiene por objeto analizar la concurrencia de un procedimiento
administrativo de apremio con un proceso concursal y la incidencia y alcance del art.
55.1 LC. En estos casos, es necesario poner en relación la concurrencia de un proceso
concursal, en el que entran en juego los derechos de crédito de diversos acreedores frente
a un deudor común, con un procedimiento administrativo de apremio, que continuará por
sus normales trámites y que finalizará con la realización del bien o derecho trabado con
anterioridad al concurso. Vamos, asimismo, a plantear cuál sería la manera más idónea
de, respetando ese privilegio procesal que la LC otorga a las Administraciones Públicas,
lograr la consecución del fundamental principio de la “par conditio creditorum”.
This paper aims to analyze the concurrence of an administrative enforcement proceedings of compulsion with an insolvency proceeding. In these cases, it is necessary to relate the concurrence of a bankruptcy proceeding, in which the credit rights of various creditors come into play vis-à-vis a common debtor, with an administrative enforcement proceeding, which will continue for its normal procedures and will end with the realization of the right or right locked prior to the contest. We will also propose what would be the most appropriate way, respecting the procedural privilege granted by the Insolvency Law to the Public Administrations, to achieve the fundamental principle of the “par conditio creditorum”.
