Abstract
La doctrina jurídica elabora entre los siglos XVI y XVIII una definición del delito que implica a su vez la definición de otros conceptos afines, como los de crimen y pecado. En la definición del delito se aprecia, entre los siglos XVI y XVII, la tensión entre los planteamientos jurídicos intelectualistas y voluntaristas, mientras que finalmente, durante el siglo XVIII, se produce un cambio en la interpretación del intelectualismo, que abandona el fundamento de la teología para asumir la razón de los derechos naturales sociales.
The legal doctrine produces between 16th and 18th centuries a definition of the offence (delictum) that in turn implies the definition of other concepts related, as crime and sin. The definition of the offence (delictum) shows, in 16th and 17th centuries, the tension between the juridical intellectualism and voluntarism approaches, until finally, during 18th century, a change occurs in the interpretation of intellectualism, that leaves the basis of theology to assume the reason of the social natural rights.
