Abstract
La necesidad de conjugar los principios constitucionales y de
naturaleza legal que deben regular los sistemas de acceso a un empleo en el sector
público, sea laboral o funcionarial, fijo o temporal, con la solución prevista en la
legislación laboral en respuesta a los casos de contratación temporal irregular está en la
base de la construcción de ese oxímoron que es el trabajador indefinido no fijo de
plantilla, con origen en la jurisprudencia y que solo de forma incompleta e imperfecta
ha tenido plasmación normativa en el Estatuto Básico del Empleo Público. En estas
situaciones, el principio de estabilidad en empleo que forma parte del contenido esencial
del derecho constitucional al trabajo pierde fuerza cuando se aplica en las
Administraciones Públicas para dar satisfacción a las exigencias constitucionales sobre
acceso a un empleo público.
The need to combine the constitutional and legal principles that must regulate systems of access to employment in the public sector with the solution provided by labour legislation in response to the cases of irregular fixed-term contracts based the construction of the indefinite temporary worker, created by the the jurisprudence and incompletely transfered to the Statute of public employment. In these situations, the principle of stability in employment that is part of the essential content of the constitutional right to work loses force when it is applied in public entities in order to meet the constitutional rules on access to a public employment .
