dc.description.abstractThe SARS-CoV-2 coronavirus and its associated disease –Covid-19– highlights the weakness of the global health system and entails an strong resurgence of a long-running debate in which the pharmaceutical industry –which has developed or is developing vaccines and drugs to treat the disease and intends to see its work rewarded– faces the general public who, as the recipient of such results, demand prompt, fair and equitable access to preventive and palliative treatments related with the coronavirus. This paper analyzes, both from a factual and legal level, the current context of the pandemic and with this purpose it makes a review of previous experiences with similar connotations and studies the legal instruments available to lessen the tensions between the relevant actors.
dc.description.abstractLa llegada del coronavirus SARS-CoV-2 y su aparejada enfermedad –Covid-19– pone de relieve la debilidad del sistema sanitario mundial y, además, hace resurgir con fuerza un antiguo debate en el que, de alguna manera, se enfrentan la industria farmacéutica –que ha desarrollado o se encuentra desarrollando vacunas y medicamentos para tratar la enfermedad y pretende ver recompensada su labor– y la ciudadanía en general que, como receptora de tales resultados, demanda un acceso rápido, justo y equitativo a los tratamientos preventivos y paliativos relacionados con el coronavirus. Esta investigación analiza, tanto desde un plano fáctico como jurídico, el contexto actual de pandemia, para lo que se procede a la revisión de experiencias anteriores con connotaciones similares y se examinan los instrumentos legales disponibles para relajar las tensiones entre los agentes implicados.
