Abstract
Se analiza el juicio ejecutivo iniciado por el vecino de Murcia Antonio Fontes y Paz contra el platero Antonio Morote en 1784, demandado por el incumplimiento del encargo de confección y modificación de unos platos de plata. En sede de oposición Morote alega su enfermedad como causa del incumplimiento de su labor, y ya en curso, el apremio de los bienes embargados el perjuicio grave por el impedimento de continuar con el desarrollo habitual de su oficio. Las actuaciones del juzgador reconduciendo el pleito por la vía del juicio ejecutivo en pos de la tutela rápida del crédito en el tráfico económico por el ciudadano resulta un interesante antecedente de la protección en materia de consumo.
This study examines analyses the executive proceeding started by a neighbor from Murcia, Antonio Fontes y Paz, versus the silversmith Antonio Morote on 1784, sued for breaches of his obligations if commission for making and modifying of some silver plates. As opposition to the enforcement Morote alleges his illness as a cause of breach of his work, and ongoing the liquidation the irreversible damage for impede the normal development of his trade. The actions of the judge bringing the process by the executive proceeding for the rapid protection of credit in economic traffic by the citizen constitutes an interesting antecedent of protection in the field of consumption.
