Abstract
La igualdad real entre mujeres y hombres sigue siendo uno de los grandes retos
del siglo XXI en todos los ámbitos de la vida social, política y económica. Desde
esta constatación, la perspectiva de género no debe ser considerara como
un mero constructo ideológico, sino como una metodología a tener en cuenta
tanto en el proceso de creación jurídica como en el posterior de interpretación
y aplicación de las normas. En este trabajo se explican los avances producidos
en clave de género en el reconocimiento de derechos laborales y prestacionales,
poniendo de manifiesto el margen de mejora que el legislador aún tiene en esta
materia, para a continuación abordar, desde un punto de vista crítico, cómo
está siendo integrada esta metodología de análisis en los pronunciamientos del
orden jurisdiccional social, en particular del Tribunal Supremo. La conclusión
es que para alcanzar la plena igualdad de mujeres y hombres en materia laboral
y de seguridad social, es preciso, entre otras medidas, legislar y juzgar con perspectiva
de género, sin complejos y con voluntad de revertir las situaciones de
desigualdad que aún padecen las mujeres, si bien ello ha de hacerse respetando
el principio de división de poderes y sin incurrir en excesos interpretativos que
menoscaben el gran valor de esta herramienta hermenéutica.
Real equality between women and men remains one of the great challenges of the 21st century in all areas of social, political, and economic life. From this observation, the gender perspective should not be considered merely an ideological construct, but rather a methodology to be taken into account both in the process of legal creation and in the subsequent interpretation and application of the rules. This paper explains the advances made from a gender perspective in the recognition of labor and welfare rights, highlighting the room for improvement that lawmakers still have in this area. It then critically addresses how this analytical methodology is being integrated into the rulings of the social jurisdiction, particularly those of the Supreme Court. The conclusion is that, to achieve full equality between women and men in labor and social security matters, it is necessary, among other measures, to legislate and judge with a gender perspective, without complexes and with the will to reverse the situations of inequality still suffered by women, while ensuring that this is done in respect of the principle of separation of powers and without resorting to interpretative excesses that undermine the great value of this hermeneutical tool.
