    Las modalidades procesales colectivas en el orden social: construcción jurisprudencial de los procesos sobre conflicto colectivo, despido colectivo e impugnación de convenios colectivos

    This paper examines the case law of the Fourth Chamber of the Spanish Supreme Court regarding the collective procedural modes established in the Act on Social Jurisdiction (Act 36/2011). It focuses on the collective dispute procedure, the collective dismissal challenge procedure, and the procedure for challenging collective bargaining agreements. Through a systematic review of the most relevant judgments, the study explores key issues such as the objective and subjective scope of each procedure, the standing of the parties, the res judicata effects, and the direct enforcement of judgments.The analysis highlights the decisive role of the Supreme Court in shaping the practical operation of collective procedural mechanisms, reinforcing the effectiveness of collective judicial protection and the coherence of the labour procedural system. It also underscores the interpretative approaches that balance the defence of workers’ collective interests with the principles of legal certainty and procedural economy. ---------------
