- PublicationRestrictedUna perspectiva comparada en tema de punibilidad: el reproche penal proporcionado(Iustel, 2020) Giraldi, Angelo; Historia Jurídica y de Ciencias Penales y Criminológicas; Facultad de DerechoThis work aims at analyzing the principle of proportionality throughout the regulation of criminal sanctions. Firstly, the work will examine the meaning of the four structural elements of the proportionality of the sanction: adequacy, necessity, ponderation of the sanction and evaluation of the legislator’s intention. These elements constitute the dogmatic setup of the proportionality of the sanction according to the German “three-step theory”, which has been modified adding the fourth step. Secondly, the influence of European Criminal Law on the mentioned setup will be analysed. Thanks to this theoretical basis, the analysis will focus thoroughly on the existing Italian Constitutional Case-Law.
