    Impact of Environmental Disclosure on Firm Performance : the Mediating Role of Green Innovation

    This study focuses on the impact of environmental disclosure on financial performance. Moreover, the current study aims to explore the mediating impact of green innovation and provide novel evidence regarding this relationship using stakeholder and signalling theory. This study used a sample dataset comprising Chinese firms listed on Shanghai and Shenzhen stock exchange for the period of 2005–2016. In our measurement model, green innovation is the partial mediator between the positive relationship of environmental disclosure and firm performance. Empirical results show that environmental disclosure affects firm financial performance directly and positively influences it through green innovation in Chinese firms. The study suggests that Chinese firms have implications for improved performance by increasing environmental disclosure and green practices.

    Infracción de patente y medidas cautelares de cesación: ¿«algo más» que infracción para concederlas o «algo menos» que infracción para denegarlas?

    La doctrina judicial que exige la presencia de «algo más» que la infracción, actual o inminente, de una patente para que se acuerden medidas cautelares de cesación es contraria a la configuración legal de esta clase de tutela cautelar, a la esencia de la protección jurídica de la patente como situación cautelable y a las exigencias del artículo 9.1.a) de la Directiva 2004/48/CE tal y como ha sido interpretado por la Sentencia del TJUE en el asunto C-688/17. En consecuencia, debe ser abandonada y retomada la doctrina que considera que la infracción vacía la esencia de la patente por sí misma y justifica por ello la concesión de medidas de cesación cautelar. Ahora bien, las concretas circunstancias del caso, si las hay, deben tomarse en consideración para denegar la cesación cautelar allí donde, a la vista del uso que el demandante hace o no hace de su patente, en realidad «hay algo menos» que infracción porque la conducta infractora no vacía de facto la utilidad de la exclusiva que confiere la patente. ------------------

    The SARS-CoV-2 coronavirus and its associated disease –Covid-19– highlights the weakness of the global health system and entails an strong resurgence of a long-running debate in which the pharmaceutical industry –which has developed or is developing vaccines and drugs to treat the disease and intends to see its work rewarded– faces the general public who, as the recipient of such results, demand prompt, fair and equitable access to preventive and palliative treatments related with the coronavirus. This paper analyzes, both from a factual and legal level, the current context of the pandemic and with this purpose it makes a review of previous experiences with similar connotations and studies the legal instruments available to lessen the tensions between the relevant actors.
